Can I ask that all readers contact the OFT and request that they investigate the use of bundled software EULAs as an unfair practise under the new Unfair Trading Regulations 2008.

Unbelievable really... I remember in 1998 when the Halloween documents came out, people were decrying the bundling of MS OSes with hardware and here we are, 11 years later, and the world's governments have still made no headway in forcing Microsoft to comply with already-standing consumer law? It's insane. I guess a corporation this big really is above the law.

As you point out, when Microsoft refer to the "product" it could mean the computer alone or the computer+software. The confusion won't stop until this issue is resolved in a court of law. I suggest sending a letter stating that you will be taking legal action if you do not receive a refund by some deadline (return post, 1 week..). Then take the retailer to small claims court, it's not difficult - fill in a form, write a page explaining the problem and include photos of the Microsoft EULA page offering a refund.

If you win, it creates legal precedence, and thousands of others following in your footsteps will be able to get refunds. Chances are, they will either fold and give you your refund, or not bother to show up in court, and you still get your refund, plus possibly some expenses.
